Article 1 – Terminology
Within these Terms and Conditions, the following definitions apply:
Cooling-off period
The legally defined timeframe in which the consumer may cancel the agreement without stating a reason.
Consumer
A natural person acting for personal purposes that fall outside any trade, business, or professional activity, who enters into a distance contract with the seller.
Day
A calendar day.
Ongoing agreement
A distance contract involving the repeated delivery of products and/or services over a certain period.
Durable data carrier
Any medium that allows information to be stored in a way that enables future consultation and unaltered reproduction.
Withdrawal right
The statutory entitlement of the consumer to dissolve a distance agreement within the applicable withdrawal period.
Seller
The natural person or legal entity that offers products and/or services to consumers via distance selling.
Distance contract
An agreement concluded through an organized system for distance selling, using exclusively remote communication methods up to and including the conclusion of the agreement.
Remote communication method
Any means that allows a contract to be concluded without the physical presence of both parties.

Article 3 – Scope of Application
These Terms and Conditions apply to all offers made by Monica Secrets and to all distance contracts and orders entered into between Monica Secrets and the consumer.
Prior to concluding an agreement, the consumer will be given the opportunity to review these Terms. If this is not reasonably possible, Monica Secrets will indicate where the Terms can be accessed electronically and will provide them free of charge upon request.
If specific products or services are subject to additional conditions, the provision most favorable to the consumer shall prevail in the event of any conflict.
Should any clause in these Terms be found invalid or unenforceable, the remaining provisions shall remain fully effective. The invalid clause will be replaced by a provision that most closely reflects the original intent.
Article 4 – Offers
Any offer with a limited validity period or subject to specific conditions will be clearly stated.
All offers are made without obligation. Monica Secrets reserves the right to change, pause, or withdraw offers at any time.
Each offer includes a clear and accurate description of the products and/or services. Images are intended to represent the products as accurately as possible, but minor variations may occur.
Offers will specify, where applicable:

The total price, excluding VAT and import duties

How and when the agreement is concluded

Whether the right of withdrawal applies

Article 5 – Conclusion of the Agreement
An agreement is concluded at the moment the consumer accepts the offer and fulfills the stated conditions.
If acceptance takes place electronically, the consumer may cancel the agreement until confirmation of acceptance has been issued.
Article 6 – Right of Withdrawal
Consumers may return non-discounted products within 30 days of receipt without stating a reason, provided the items are unused, undamaged, and returned in their original packaging.
Items purchased under Final Sale conditions, defined as products discounted by 40% or more, are excluded from returns, refunds, and exchanges. This exclusion is clearly communicated before purchase.
Article 7 – Costs in Case of Withdrawal
When the right of withdrawal is exercised, return shipping costs are the responsibility of the consumer. Returned items must be shipped directly to Monica Secrets’ overseas fulfillment partner located in China.
Refunds, including standard outbound shipping costs, will be processed within 14 days after receipt of the returned goods or valid proof of return shipment.
Article 8 – Withdrawal Exceptions
The right of withdrawal does not apply to:

Products excluded for hygiene reasons, including earrings and lingerie

Items purchased during Final Sale promotions with discounts of 40% or more
Article 9 – Pricing
Prices stated in an offer remain valid for the duration of the specified offer period, unless adjustments are required by law or regulation.
Article 10 – Product Conformity and Warranty
Monica Secrets guarantees that products and services conform to the agreement and meet reasonable standards of quality, usability, and reliability.
Article 11 – Delivery and Order Processing
Orders are handled with due care.
If delivery is delayed, the consumer will be informed as soon as reasonably possible.
Article 12 – Payment Terms
Unless explicitly agreed otherwise, payment must be completed in full at the time the order is placed.
All transactions conducted through Monica Secrets are subject to these Terms, which define pricing, payment conditions, and delivery policies. Monica Secrets reserves the right to correct errors in pricing, product descriptions, or availability at any time.

Article 14 – Applicable Law
Monica Secrets is operated by a company registered in the Netherlands. All agreements between the seller and the consumer are governed by Dutch law.
These Terms are subject to Dutch law unless mandatory consumer protection legislation in the consumer’s country of residence provides otherwise. Statutory consumer rights remain unaffected.
Article 15 – Amendments to the Terms
Monica Secrets reserves the right to amend these Terms and Conditions. Any changes will be communicated at least 30 days prior to taking effect.
Article 16 – Shipping and Returns
Monica Secrets works with third-party logistics partners based in China. Orders are therefore shipped from China.
Approved returns must also be sent to China. Return instructions and the applicable address will be provided after a return request has been approved.

Article 17 – Legal Disclaimer
Return and exchange policies may be modified at any time. Monica Secrets retains final discretion regarding the approval of return or exchange requests.
Nothing in these Terms limits or excludes rights granted under applicable consumer protection laws. Statutory rights remain fully intact and may vary by country of residence.
Winter Sale Conditions
The winter promotion is valid until February 28, 2026. After this date, promotional conditions and product availability may be amended or automatically expire.
